1. Services

KiteLabs provides software development, web development, and related digital services. The specific scope, deliverables, and timelines for any project are defined in separate service agreements or proposals.

2. Payments and Billing

• Payment terms are specified in individual service agreements or invoices
• All payments are due within the timeframe specified on the invoice (typically 14-30 days)
• Payments are processed securely via third-party payment processors such as Paystack and Stripe
• We do not store your complete payment credentials; all transactions are handled by PCI-DSS compliant processors
• Late payments may incur additional fees as specified in your service agreement

3. Refund Policy

Refunds are handled on a case-by-case basis and depend on the nature of the service provided:

• For project-based work, refunds may be available for undelivered portions of work
• Subscription services may be cancelled and prorated refunds issued for unused periods
• Custom development work already completed is generally non-refundable
• Refund requests must be submitted in writing to info@kitelabs.app

4. Use of Information

We collect limited information (name, email, company details, and payment records) to deliver our services and maintain accurate business records. Please refer to our Privacy Policy for full details on data handling.

5. User Conduct

By using our platform and services, you agree not to:

• Use the platform for illegal or fraudulent activities
• Impersonate another person or provide false information
• Interfere with the platform's functionality or security
• Attempt to reverse-engineer, copy, or redistribute our proprietary software
• Violate any applicable local, national, or international laws

6. Intellectual Property

All content on this website, including text, graphics, code, and branding, is the intellectual property of KiteLabs unless otherwise stated. You may not copy, distribute, or reuse any content without explicit written permission.

For custom development projects, intellectual property ownership is specified in individual service agreements. Generally, clients receive full ownership of custom code upon final payment.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our engagement. This includes business strategies, technical specifications, and any non-public information.

8. Platform Availability

We strive to keep our platform and services available at all times, but we do not guarantee uninterrupted access. Services may be temporarily suspended for maintenance, updates, or technical issues, with reasonable notice when possible.

9. Limitation of Liability

To the fullest extent permitted by law, KiteLabs shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from:

• Your use of or inability to access our platform or services
• Failed transactions or payment processing issues
• Data loss, unauthorized access, or security breaches beyond our reasonable control
• Third-party services, APIs, or integrations

10. Indemnification

You agree to indemnify and hold harmless KiteLabs, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through the courts of Kenya.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. We will notify users of significant changes via email when possible.
